Practice Areas: Identifying Intellectual Property Rights

Benjamin L. England & Associates works with companies to identify their intellectual property and understand the rights that accompany the property. We serve our clients by conducting patent searches (such as for novelty or patentability), providing Freedom To Operate opinions (FTO), or right-to-use opinions. Once the property is identified, we prepare, file, and prosecute national (with the U.S. Patent and Trademark Office (USPTO)) and international (relying on the Patent Cooperation Treaty (PCT)) patent applications, such as utility patents. Our team has experienced patent prosecutors who are registered to practice in front of the Patent Office.

We thoroughly review each invention and work closely with the inventor to understand the technology in order to provide the greatest protection for the invention. We draft patents with a comprehensive view of the invention, to deter designing around the invention, and protect any commercially valuable embodiments.

Additionally, we work with companies to identify and develop their trademarks. We serve our clients by conducting trademark searches, to avoid infringing on others. Then we prepare, file, and prosecute national trademark registration with the U.S. Patent and Trademark Office). By working closely with companies, we help them protect one of the most important pieces of property: their mark.
